To all people to whom these presents shall come, Daniel Mohler of Allen township in the county of Cumberland and state of Pennsylvania yeoman one of the sons and legatees named in the last will and testament of John Mohler, late of Cocalico township in the county of Lancaster and state aforesaid yeoman, deceased, Henry Mohler of Warwick township in the county and state last aforesaid yeoman another of the sons and legatees named in the last Will and testament of the said deceased, Samuel Foss of Cocalico township in the county and state last aforesaid, weaver, and Elizabeth his wife late Elizabeth Mohler, one of the daughters & legatees named in the last will and testament of the said deceased, Samuel Landis Esqr., of the same place last aforesaid and Hannah his wife late Hannah Mohler, another daughter and legatee named in the last will and testament of the said deceased, Joseph Shirk of the same place last aforesaid and Catherine his wife late Catherine Mohler, another daughter and legatee named in the last will and testament of the said deceased, John Royer of Manheim township in the county & state aforesaid and Esther his wife late Esther Mohler, another daughter and legatee named in the last will and testament of the said deceased, Philip Wiest of Augusta county in the state of Virginia and Nancy his wife, late Nancy Mohler, another daughter and legatee named in the last will and testament of the said deceased, John Eichholtz, of Allen township in the county of Cumberland and state of Pennsylvania, and Solome his wife, late Solome Mohler, another [blank] and legatee named in the last will and testament of the said deceased, Mary Markley of the same place last aforesaid, Widow, late Mary Mohler, another daughter and legatee named in the last will and testament of the said deceased, John Studenbacker of Tirone township in the county of Adams and state last aforesaid, and Rebecca his wife late Rebecca Mohler, another daughter and legatee named in the last will and testament of the said deceased, and Benjamin Reigle of Benton township in the county of Yates and state of New York, and Susanna his wife late Susanna Mohler, another daughter and legatee named in the last will and testament of the said deceased, Send Greetings.

Whereas Daniel Bauman and Jacob Keller, Executors of the testament and last will, of Henry Mohler, (the Elder) deceased by virtue of the power and authority to them given by the said Will and pursuant to the direction thereof did by Indenture under their hands and seals bearing date the twenty sixth day of December anno Domini one thousand seven hundred and eighty six for the consideration therein mentioned grant and confirm unto the said John Mohler and to his heirs and assigns Two certain pieces and tracts of land situate in Cocalico township in the county of Lancaster the first thereof being bounded by the lines as follows to wit Beginning at a stone a corner of Henry Mohler's land thence south thirteen degrees West eighty two perches to a stone thence by land late of Israel Semord north forty six degrees east thirty one perches and a half to a Black Oak thence north eighty four degrees east thirty eight perches to a white oak thence by land of Jacob Mohler north thirteen degrees east, sixty two perches to a chesnut thence north sixty three degrees east twenty seven to a hickory thence South fifteen degrees east, one hundred and twelve perches to a stone, a corner of land late of said Israel Semord thence north seventy two degrees east forty nine perches to a White Oak, thence my lands of Dewalt Meather, north seventeen degrees West, one hundred & sixteen perches to a hickory, thence north sixty three degrees east, thirty five perches to a stone, thence north forty six degrees west, seventeen perches to a stone, north Eighty three degrees east, eighty three perches to a stone, thence north forty nine degrees West, fifty six perches and one quarter to a stone thence south thirty eight degrees west sixteen perches and one quarter to a stone, thence north twenty two degrees West, thirty seven purchase and a half to a stone, thence south seventy seven degrees West, one hundred & ten perches to a Walnut, thence by land of the said Jacob Mohler, south eighteen degrees east, twenty five perches to a stone, thence soth five degrees west, twenty seven perches and three quarters to a stone, thence [blank] thirty eight degrees east, eight perches and a half to a stone thence south five degrees west, seventy three perches to a stone, thence south eighty three degrees west, fourty four perches to the place of beginning Containing one hundred thirty nine acres and sixty perches of land and the usual allowance of six percent, &cc The other tract containing nine acres and one hundred perches and the usual allowance &cc with the appurtenances to hold the same to him his heirs and assigns forever, as in and by the said recited Indenture relation being thereunto had may more fully and at large appear By Force and Virtue of which said recited Indenture & of some other good conveyances and assurances in the law duly had and executed the said John Mohler became in his life time lawfully seized in his demesne as of fee of and in the said tracts of land with the appurtenances and being so thereof seized with other real estate, died first made his last will and testament in Writing bearing date the third day of January anno Domini, one thousand eight hundred and eighteen wherein and Whereby amongst other things he did give and devise unto his son John Mohler, and to his heirs and assigns in the Language and words following to wit: "Item, I give and bequeath unto my son John Mohler all my Plantation or tract of land whereon we now live being the same what I got of my Father, excepting the nine acres and one hundred perches adjoining the buirring grounds and the five acres and one hundred and thirteen perches adjoining the lands I purchased of Joseph Groff according to the Draught thereof the remainder being about one hundred and forty two acres neat measure, To hold to him my son John Mohler, his heirs and assigns forever, Provided that he my son John Mohler, his heirs and assigns, shall allow, render, & deliver all and every the rights and incomes out of and one the same to my widow during her widowhood as before mentioned and also shall payfir the same the sum of four thousand one hundred and forty pound lawful money of Pennsylvania in manner following, that is to say the sum of four hundred pound he shall keep and retain thereof on account of his portion, out of my estate and twelve hundred pound shall remain charged thereon during the Widowhood of my Widow to enable him to give to her what is given to her out of the same, and on the first day of April after my decease the sum of two hundred pound and then yearly and every year next following on the first day of April the sum of two hundred and twenty five pound until the whole is paid of and discharged and out of the twelve hundred pound which is charged thereon as aforesaid, I give and bequeath the sum of three hundred pound thereof unto my said son John Mohler, and the remaining nine hundred pound he shall pay after the decease or marriage of my widow in six annual payments of one hundred and fifty pounds each to commence one year after her decease or marriage, Item its my will and I order that all the money arising and of the sale of my real and personal estate and Whatsoever I have charged any of my children for the land to them herein given and all legacies given to my children and whatsoever I have given to my children which is charged to them in my book fir that purpose shall be added together and then divided into twelve equal shares so that out of the whole each of my children shall have one equal twelfth part thereof &cc as in and by the said recited will since his decease duly proven and remaining in the Registers Office at Lancaster relation being thereunto had may more fully at large appear, Now Know Ye, that the said Daniel Mohler, Henry Mohler, Samuel Fess & Elizabeth his wife Samuel Landis and Hannah his wife, Joseph Shirk and Catherine his wife John Royer and Esther his wife, Philip Wiest and Nancy his wife, John Eichholz and Solome his wife Mary Markley, John Studenbacker and Rebecca his wife and Benjamin Riegel and Susanna his wife, for and in consideration of the sum of Three housand four hundred and forty pounds lawful money of the United States to us well and truly in hand paid by the said John Mohler the devisee in the above recited Will at and before the ensealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said John Mohler his heirs executors & administrators by these presents, have and each and every of them hath remised released and forever quit claim & by these presents do and each and every of them doth remise release and forever quit claim unto the said John Mohler, and to his heirs and assigns, All the estate and estates, shares purports & dividends right title interest property claim and demand whatsoever of them the said Daniel Mohler, Henry Mohler, Samuel Fess and Elizabeth his wife, Samuel Landis and Hannah his wife, Joseph Shirk and Catherine, his wife John Royer, and Esther his wife Philip Wiest, and Nancy his wife, John Eichholz and Solome his wife, Mary Markley, John Studenbacker, and Rebecca his wife and Benjamin Riegel, and Susanna his wife, in law or equity or otherwise howsoever of in to or out of all that certain Messuage or tenement Plantation and tract of land situate lying and being in Cocalico township in the county of Lancaster in the actual possession and Seisin of the said John Mohler now being by causes and distances Marks and bounds above particularly described containing one hundred thirty nine acres and sixty perches of land and allowance of six percent &cc, Together with al and singular other the buildings improvements, rights, members and appurtenances whatsoever Hereunto belonging or in any wise appertaining (Excepting five acres and one hundred and thirteen perches reserved by the above recited Will) remainder mentioned to contain about one hundred and forty two acres neat measure) and the reversions and remainders rents issues and profits thereof, To have and to hold all and singular the premises hereby remised and released or mentioned and intended to be with the appurtenances nto the said John Mohler his heirs and assigns to the only proper use and behoof of the said John Mohler, his heirs and assigns, forever, (Except as before excepted) So that neither the said Daniel Mohler, Henry Mohler, Samuel Fess and Elizabeth his wife, Samuel Landis and Hannah his wife, Joseph Shirk, and Catherine his wife John Royer and Esther his wife, Philip Wiest, and Nancy his wife John Eichholz and Solome his wife Mary Markley, John Studenbacker, and Rebecca his wife and Benjamin Riegel, and Susanna his wife nor their heirs nor any other person or persons whomsoever lawfully claiming or to claim by from or under them or any of them shall or may at any time or times hereafter have claim challenge or demand any estate right title or interest of in to or out of the said Mesuage or tenement and tract of land devised to the said John Mohler a aforesaid and said to contain one hundred and forty two acres neat measure, hereditaments and premises hereby remised and released or mentioned or intended so to be with the appurtenances or any part or parcel thereof but thereof and therefrom shall and will be utterly Lancaster County SS, On the 19th day of November, 1838, Before me the Subscriber, one of the Justices of the peace in and for said county personally came the above named Philip Wiest and Anna his wife and acknowledged the above written Indenture to be there act and deed and desired that the same might be recorded as such according to law, she the said Anna being of full age and by me examined as the law directs separate and apart from her said husband, the full contents of the above written Indenture being by me made known to her and she declared that she did Voluntarily and of her own free will and accord as and for her act and deed Sign Seal execute and deliver the same without any coercion or compulsion of her said husband, In testimony whereof I have hereunto set my hand and seal the day & year aforesaid R.
