THIS INDENTURE Made this Third day of March Anno Domini One Thousand Seven Hundred and Seventy four BETWEEN Henry Mohler Junior Jacob Mohler and Martin Mohler all heirs at Law of Henry Mohler Senior late of Cogollico Township Lancaster County Yeoman deceased of the one Part and Jacob Gorgas of the said Township & County Clockmaker of the other Part WEREAS the said Jacob Gorgas in and by a Certain Obligatory Note bearing date the first day of Junius Anno Domini 1766 did bind himself unto said Henry Mohler deceased in the Sum of One Hundred and Sixty Pounds Lawfull Money of Pennsylvania Conditioned for the Payment of the Sum of Eighty Pounds aforesaid AND WHEREAS in Order to secure the better the Payment of the aforesaid Debt unto the said Henry Mohler Senior his heirs and Assigns the said Jacob Gorgas did Mortgage unto the said Henry Mohler Senior deceased certain Sixteen Acres One half of an Acre and Ninety seven Perches of Land Situate in the said Township and County as in and by the sd. Mortgage Deed bearing date the Twenty third day of Junius A. D. 1766 and recorded at Lancaster in the Office for Recording of Deeds for the County of Lancaster in Book H. Page 332 &c. Relation being thereunto had more fully and at large Appears AND WHEREAS the said Henry Mohler Senior after having received of & from the aforesaid Jacob Gorgas in his life time the Payment of the aforesaid Debt both principal and Interest was by death prevented to acknowledge satisfaction upon the above in Part recited Mortgage according to the Form of Law made for that Purpose NOW THIS INDENTURE WITNESSETH that we the above nominated heirs at Law of Henry Mohler Senr. deceased in Consideration that the said Jacob Gorgas hath truly and honestly discharged the aforesaid Debt Together with Interest unto the aforesd. Henry Mohler Senior deceased in his life time do hereby discharge and clear the said Jacob Gorgas his heirs and Assigns from all Demands whatsoever which could be made of him them or either of them by the heirs of the aforesd. Henry Moher Senior deceased their Heirs or Assigns as relating the aforesaid Debt or any part thereof and do also declare the above in part recited mortgage to be void and of none effect as to all its Clauses intents & Obligations and further we do hereby engage with and promise to the said Jacob Gorgas his heirs & Assigns for ourselves our heirs and Assigns that we will warrant and defend the said Jacob Gorgas his heirs and Assigns and every of them against any Demand made to the aforesaid Debt or the Lands for the Same Mortgaged as aforesaid by us our heirs and Assigns & all and every other Person or Persons claiming said Debt or any part thereof or the said Lands or any part thereof by from or under us them or and of them or any of the Heirs at Law of the said Henry Mohler Senior deceased & that forever IN WITNESS whereof we have hereunto set our Names & Seals the day & Year first above written Henrich Mohler (L S) Jacob Mohler (L S)
