The Last Will and Testament of Jacob Moler
This is a retype of Jefferson County Court ,

Jacob Moler's will is interesting in the fact that
Jacob's sons Michael and John, who were named executors, both refused the
position, and wife Jane was then appointed Executor
In the name of God amen, I, Jacob Moler of Jefferson County and State of
Virginia being of sound mind and memory but weak in body and calling to mind the
uncertainty of all human things and that it is appointed once for man to die I
do therefore constitute and appoint this to be my last will and testament
revoking all other will and disannulling all other Instruments of writing that
may have been made or wrote by heretofore declaring this to be my only will and
testament. I do therefore recommend my Soul to God my Savour who gave it hoping
he will receive the same for the sake of his son. I direct my body to be buried
in a christian like manner by my Executors hereinafter named.
Item Its my will that all my Just debts shall be paid
Item I do give to my loving wife, Jane Moler during her
natural life the plantation whereon I now live, three horses to wit Young
Linny, Snap, and Flye with my Wagon and Gears together all my plantation
utensils with all my stock cattle sheep and hogs all my
household and Kitchen Furniture all the provisions laid up for the present years
as also one hundred Dollars in Cash during her natural life unless she the said
Jane Moler should Intermarry after my death then it is my
will that my Executors deposit of by sale or other wise the two thirds of
personal estate that may then come into their hands and rent out the 2/3 of the
plantation that will then come into hands until the death of my wife Jane Moler.
Having made ample provision for my wife Jane Moler I wish and direct that my
children be given a common education out of such proceeds that may be left after
supporting her and those of my children that may live with her the said Jane
Moler. It is my will and I do direct that my Executors do add towards the
education of my children so much of the interest that may grow out of those
moneys that may be in their hands from time to time as will fully carry my
wishes into effect as to the schooling of my children and should this be found
not sufficient that they do apply so much of the principle as will do it, it is
my will and I direct that my executors do at the death of my wife Jane Moler
sell all my estate real and personnel for the best price they may get for the
same.
Item I give to my son Henry Moler one hundred dollars.
Item I give to my Daughter Nelley Moler one hundred dollars.
Item I give to my daughter Anna Moler one hundred dollars.
It is my will and I do direct my Executors to make an equal division among all
my children that may then be surviving including Henry Moler, Nelly Moler and
Anna Moler of the balance of estate. I do hereby constitute
and appoint Michael Moler and John Moler my Executors to this my last will and
testament as witness my hand and seal this 14th day of March 1804.

In the present of Alexander Sanderson, Jesse Moore, Isaac Strider and
Jacob Strider
At a Court held for Jefferson County the 12th day of June 1804. This
last will and testament of Jacob Moler deceased was proven by the oaths of Isaac
Strider Jacob Strider and Jesse Moore three of the witnesses thereto and ordered
to be recorded, and thereupon John Moler one of the executors named in said will
came into Court and refused to take upon himself the burden of the execution
thereof which is ordered to be certified. And at a court continued and held for
the said County of Jefferson the 13th day of the month and year
aforesaid Michael Moler the other executor named in the said last will and
testament of Jacob Moler deceased came into court and refused to take upon
himself the burden of the execution thereof which is ordered to be certified.
And on the motion of Jane Moler, widow and relict of said
Jacob Moler deceased who made oath thereto according to law, certificate is
granted her for obtaining letters of administration with the will annexed of
said Jacob Moler deceased giving security. Whereupon she together with security
entered into, and acknowledged bond conditioned for her due and faithful
administration of the said decedents estate.
